Ace Bongae Crank, who in February was charged with having sex with a woman who was too intoxicated to consent, was sentenced Tuesday to five years probation and ordered to undergo a psychological evaluation.

Circuit Court Judge John Brown passed sentence after Crank, of Santa Rosa Beach, pleaded no contest to a single charge of felony battery. A charge of video voyeurism was dropped.

The probated sentence was offered after a discussion with the victim, according to Bill Bishop, the chief assistant state attorney for Okaloosa County.

“Based on the facts and circumstances of the case we felt it could have been problematic to prove the charges beyond a reasonable doubt,” Bishop said.

The victim also preferred not to go through the trauma of a trial, Bishop said.

An arrest report states that the woman assaulted by Crank had attended a Roy Jones Jr. boxing match at the Pensacola Bay Center, where she had several drinks.

Following the fight she rode with Crank in a rented limo, and the two stopped in Gulf Breeze to get more alcohol.

Crank told authorities that when he met the victim, she was already “loose and loopy.”

He said that before they arrived at a Destin bar she threw up in the limousine, was incoherent and whispering, the report said. He got her out of the limo, where she threw up again. He put her in his car, where she was trying to open the door as he was driving and he pulled over in the Destin Middle School parking lot.

Deputies came upon the white Mercedes limousine in the parking lot. Crank admitted to authorities he was engaged in sexual activity with the victim at the time the officer arrived and told them to get out of the car.

Officers reported the victim's clothing was in disarray when she stepped out of the vehicle.

The victim told deputies she didn’t remember much of the evening, the report said, and that her head was “hazy.”

Asked if she remembered being in the back of Crank’s limo or giving Crank consent to have intercourse, the victim replied, “no, because I don’t remember,” according to the report. “I don’t even remember getting in the car.”

She told the deputy that even if she was sober, she would not have given Crank permission to have sex with her, the report said.
